13.5  To protect public health and safety, all BODY ARTISTS performing BODY ART PROCEDURES outside of a fixed BODY ART ESTABLISHMENT and/or for educational, trade show, convention, event, performance, or product demonstration purposes must be LICENSED by the DEPARTMENT to ensure compliance with this Code and all jurisdictional regulations. BODY ARTISTS seeking a temporary body art license shall be affiliated with the TEMPORARY BODY ART FACILITY as an approved participant/artist. Affiliation shall be verified by the TEMPORARY BODY ART FACILITY license holder. This requirement ensures accountability, maintains event standards, and upholds public health and safety regulations. TEMPORARY BODY ART FACILITY license holders shall be responsible for ensuring that all applicants meet the license requirements for a TEMPORARY BODY ARTIST and shall ensure that any artist not meeting these requirements are removed from the TEMPORARY BODY ART FACILITY. Requirements and application timelines for temporary BODY ART LICENSES will vary by jurisdiction. 13.5.2.2.114.4.2.2.1 This Section should state that the applicant must provide proof of compliance with Section 13.3 above. This change will be made in the pending update of this Code.

13.6 MOBILE BODY ART ESTABLISHMENTS

1.  A MOBILE BODY ART ESTABLISHMENT shall not operate at any single location/event or under any single permit for more than 14 consecutive days to prevent continuous or permanent operation from a MOBILE BODY ART ESTABLISHMENT. Due to the inherent limitations of MOBILE BODY ART ESTABLISHMENTS in maintaining long- term environmental controls, this restriction is necessary to ensure that infection control standards can be effectively maintained. To prevent cross-contamination, BODY ART PROCEDURES and related activities must be conducted in enclosed spaces separate from any activities unrelated to BODY ART PROCEDURES. MOBILE BODY ART ESTABLISHMENTS shall be maintained in a condition that prevents contamination, ensures surfaces are free of visible soil and debris, and supports safe and hygienic operation. Unless specified elsewhere in these requirements, MOBILE BODY ART ESTABLISHMENTS must meet the same requirements as BODY ART ESTABLISHMENTS at fixed locations.
